Membership Plan — Terms & Conditions

By enrolling in this Membership Plan, in person or online, the enrolling member acknowledges that they have read, understood, and agree to these Terms & Conditions.

1. Nature of the Plan

This Membership Plan is a dental savings plan offered directly by Birdwell & Mutlak Dentistry ("the Practice"). It is not dental insurance, is not regulated as an insurance product, and does not involve any third-party insurer. It is a direct agreement between the enrolling patient (or, for a minor, their parent or legal guardian) and the Practice.

2. Term and Renewal

Membership is valid for 12 months from the enrollment date ("the Term"). At the end of the Term, membership automatically renews for successive 12-month periods unless canceled as described in Section 4. Annual members receive a payment notification before their renewal charge. Monthly members commit to a minimum 12-month Term, billed monthly, which automatically continues month-to-month after the initial 12 months unless canceled.

3. Fees and Billing

Membership fees are billed through the Practice's payment processor according to the plan tier and billing cadence (annual or monthly) selected at enrollment. Family members who enroll together in a single transaction are billed as one combined payment on a shared schedule; family members who enroll separately are billed independently on their own schedules. See Section 7.

4. Cancellation and Early Termination

Members may cancel at any time after completing the initial 12-month minimum commitment with no penalty. A member who cancels before completing the 12-month minimum commitment owes the remaining balance up to the full 12-month plan cost.

5. Non-Refundable Fees; Unused Services

Membership fees are non-refundable. Any included services not used within the 12-month Term are forfeited; they do not roll over and are not eligible for a refund or credit. Exception: if a member cancels before receiving any services under the plan, the Practice may, at its sole discretion, apply the payment as account credit rather than treating it as forfeited.

6. Failed Payments

If a scheduled payment fails, the Practice's payment processor automatically attempts to retry the charge. If payment continues to fail, the Practice will contact the member to update payment information, and the account may be placed on hold until payment is resolved.

7. Family Enrollment

Family members may enroll individually, each starting their own independent 12-month Term and billing schedule, or together in a single enrollment transaction. Family members enrolled together in a single transaction share one combined subscription, are billed as a single combined payment, and share a single renewal and cancellation status — canceling a combined family subscription cancels membership for every family member included in it. Family members who enroll separately, at different times, are billed and renewed independently of one another. A discount is available for additional household members enrolling alongside an existing or newly enrolling member of the same household; current terms are available from the Practice.

8. What's Included

Each membership tier includes one new-patient or recall exam with cleaning, one problem-focused exam, one set of bitewing X-rays, up to four (4) periapical (PA) X-rays per year, and two (2) routine cleanings per year, plus a discount on additional treatment as stated at the time of enrollment. Included services and discount rates are as described in the Practice's enrollment materials at the time of enrollment; a member's own rate remains as agreed for the duration of their current Term even if rates change for future enrollees.

9. Perio Plan

A member diagnosed with periodontal disease may be offered the option to move to the Practice's dedicated Perio Plan, structured around periodontal maintenance visits rather than routine cleanings. A member may decline this option, in which case periodontal maintenance visits will be billed separately at the Practice's standard rate, without the plan discount applied.

10. Exclusions

This plan does not cover and cannot be applied toward veneers, cosmetic procedures, or retail products purchased in-office. Membership cannot be combined with dental insurance or any other discount, offer, or promotion.

11. Eligibility and Restrictions

This plan is valid only at Birdwell & Mutlak Dentistry and is not transferable to any other dental office or provider.

12. Changes to These Terms

The Practice reserves the right to modify these Terms, pricing, and plan offerings for future enrollment periods.
